Biofuels advocates send message as Trump mulls 10th Circuit SRE appeal

Biofuels advocates are sending a clear message to the Trump Administration amid speculation the EPA will appeal a recent 10th Circuit Court ruling on small refinery exemptions.

“Move forward with this 10th Circuit case ruling and have EPA apply this decision nationwide.”

That’s Iowa farmer Kevin Ross, president of the National Corn Growers Association.

During a call with reporters this morning, Ross and fellow Iowa farmer Dave Walton expressed frustration with the Administration for flip-flopping on biofuels policy.

“Just a couple weeks ago at Commodity Classic, thousands of us applauded when Ag Secretary Perdue assured farmers that this court case would finally end EPA’s demand destruction.”

Badger State Ethanol CEO Erik Huschitt told reporters an appeal would likely damage President Trump’s reelection campaign.

“If this Administration joins this appeal, it will send a strong, strong signal that the President is choosing two oil refinery companies that account for less than one percent of the capacity over hundreds of thousands of farmers in Wisconsin and dozens of other states.”

The White House has received an additional two weeks to decide whether to appeal the 10th Circuit Court decision.
