Appeals court cancels order to shut down Dakota Access pipeline

An appeals court has cancelled a judge’s order to shut down the Dakota Access pipeline.

The three-judge panel found that the lower court did not have the necessary findings to temporarily shut down the pipeline for an environmental review. But those judges rejected the motion by Energy Transfer to block the review.

North and South Dakota ag groups, including the South Dakota Corn Growers, Farm Bureau and the state’s soybean association, asked the court to stay the district court ruling saying it would greatly increase the costs of transporting commodities.
